「E-2」の申請は日本にある米国大使館で行う。ビザが発給されるのに必要な要素は大きく分けて2つ。1つは『事業計画』で、そのビジネスが成功すると大使館が納得できるだけの、判断材料をそろえる必要があり、事業内容だけでなく、オフィスの不動産契約、会社設備や備品の準備のめどなど、具体的な実現可能性が求められる。もう1つは「資金」。自らの事業にどれだけお金を投入できるかが問われる。大使館は、過去の事例を参照して、厳格な審査を行う。
